PICKETT FAMILY OF NORTH CAROLINA


Some Notes: 

I find a James and William Pickett listed in the 1792-1793 Richmond Co
Sheriff's Tax Book.

The following Picket's are listed in the 1784-87 NC census book.  But some
counties are missing.

All of these are in Duplin County:   Henry, James, Margaret, Sherrod, Simon,
Solomon, Wm, and Wim. (2)

In Richmond county, there is one James Picket.

State No Carolina -- 15 Sept. 1795 Anson County --In the Name of God Amen.
I James Pickett of the County aforesaid being weak in Body but of sound
mind & memory thanks be to Allmighty God for the same, but calling to mind
that it is apointed once for all man kind to die, Do make and ordain this
to be my Last Will and Testament.

[Illegible] and first of all I give [three illegible words] and commit
my soul to God who gave it me and my body to the earth from where it came,
and as to my worldly property I dispose of them in the manner and
form following

--First I lend to my loving wife Martha Pickett two hundred acres of land
being the upper part including the plantation where Wm Roberd now lives
also (those?) my 2 Negroes named (Candass?) & Jacob to be by her enjoyd
during her natural life and at her death the said Jacob to descend to my
son Martin Pickett and Candus to be disposed of as my wife should
thinkproper.

--2nd I give to my daughter Mary Robards this my negro girl [illegible] Anny
to her my sd daughter and to the heirs of her body forever and in case
she should die leaving no issue then the said negro Any to descend to my
daughter Franky Hannah Pickett and to the heirs of her body forever.
3ly I give to my son Martin Pickett those my 3 Negroes named David, Milly
& Jane which said negros are at this time in his possession to be by him
Injoyd forever.

--4ly I give to my son Joseph Pickett those my 4 Negroes named Suckey and
her 3 children Sam Jane & Ralph to be by him Injoyd forever.

--5ly I give to my son Wm. R Pickett those my 3 Negroes named [illegible]
and her 2 children (Iube - - er ?) & Frank to by him injoyd forever.

--6ly I give to my daughter Franky H Pickett those my 2 Negros name Amy &
(Ennys?) to her the said Franky Hannah and to the heirs of hir body forever.

--7ly I give to my 3 sons Martin Joseph & Wm R Pickett all my lands to be
equally divided amongst them in quantity and [illegible].Brought over

--8ly I give all my stock of every kind together with my house hold furniture
of every kind, to be equally divided between my wife Martha Pickett and
my 3 children to wit Joseph Wm R & Franky Hannah Pickett and to be by them
enjoyed forever. I [illegible] I give to my 3 sons Martin Joseph & Wm R
Pickett One Negro man named Ned a black smith by trade together with the
tools and that the profits arising from said negro be equally divided
amongst them.

--9ly I give all the residue of my property that has not been mentioned
above to my 5 children Mary Robards, Martin, Joseph, Wm Raiford Pickett and
daughter Frank H Pickett to be equally divided amongst them.

--10ly I do ordain constitute and appoint my loving wife Martha Pickett my
Executrix and my son Joseph Pickett and Martin Pickett & James Terry my
brother in law executors to this my Last will and Testament.

In the name of God Amen--
I Martha Pickett of Richd County in the State of North Carolina being in
Common state of health and sound mind & memory do make & ordain this this
[sic] my last will & Testament in manner & form following that is to say
Imprimo I give and bequeath to my well beloved daugh-ter Polly Robards
my Negroe Woman Candace during her natural life and at my daughters death
and the said Negroe Woman Candace is to have her freedom forever.

And lastly I give and bequeath to my four beloved children Martin Pickett,
Joseph Pickett William R. Pickett & Frances H DeJernett the whole balance
of my estate without any reservation whatever to be equally divided by
my executors share and share alike.

I constitute and appoint Martin Pickett Joseph Pickett & William Pickett
Executors to this my last will and Testament revoking all others heretofore
by me made Martha Pickett {seal}

I Martin Pickett do make and ordain this instru-ment my last will and
testament, that is to say, my will and desire is that my whole Estate both 
real and personal shall be equally divided betwean my beloved wife Winey 
(Wincy?) Pickett and my three children, viz. Eliza Pickett, Martha Pickett, 
and William Martin Pickett, and I constitute and appoint my wife Winey 
(Wincy?)Pickett and Absalom (Myres?) my Executors to carry this my last Will 
and Testament into effect disannulling all others the day and year above 
writen & subscribed to by my self in the presence of the witnesses,

In the name of God Amen.  I William Terry of Anson County being
very sick & weak in mind but in perfect mind & memory thanks be
unto God Calling to mind the mortality of my body & knowing that it
is appointed for all men (one?) to die do make & ordain this my Last
Will & Testament that is to say Principal-ly & first of all I give &
recommend my soul unto the hand of Almighty God that gave it & my
body I Recommend to the Earth to be buried in decent Christian burial
at the Discretion of Executors nothing Doubting but at the General
Resurrection I shall receive the same again by the might power of God
& as Touching such worldly Estate wherewith it has pleased God to
bless me in this Life I give devise and of the same in the following
manner & form.

--Item  I give to my Daughter Martha Pickett one negro named Tom and
Twenty pounds prock.

--Item  I give unto my son James Terry all my Lands by him freely to be
possessed & Enjoyed also one negro man named Bob.

--Item  I give to my Daughter Mourning Coleman one negro boy named
Shaper.

--Item  I give to my Daughter Margarett Smith one negro Girl named
Jude.

--Item  I give to Elizabeth (Hellams?) one cow & calf one feather bed &
furniture then after my lawfull Debts is paid I Lend all the rest of my
Estate unto my wife Mary Terry During her natural Life & after her
Decease sixty pounds to be Raised out of the Estate and Equally Dived
between my three Daughters Martha Mourning & Margarett & the Rest
to be Equally Divided amongst the four chil-dren above mentioned  To
wit

Martha James Mourning & Margarett.

Lastly I appoint my son James Terry & my wife Mary Terry Executor
of this my Last Will and Testament & I do hereby utterly Disallow
revoke & Disannul all & Every other former Testament In witness
whereof I have set my hand and seal this (6 ?) day of September one
thousand seven hundred & seventy five

This is the last will and testament of me Mourning Pickett / widow / of 
the Town of Rockingham and State of North Carolina. I will and [illegible] 
that all my just debts, funeral expenses, and the charges of proving this 
will, and carrying it into effect be fully paid by my executors 
hereinafter named as soon as conveniently can be after my decease.

I give and bequeath to my worthy friends Walter Leak of this place and 
William Terry of the Town of Sneedsborough & State aforesaid their heirs 
executors & administrators and assigns all my estate both real & personal 
to which I am in any manner entitled at my decease to hold the same to the 
said Walter & William their heirs executors & administrators. Upon trust 
[illegible] [illegible] that they the said Walter Leak & William Terry or 
the survivor of them or the heirs executors or administrators of such 
survivor do & shall with all convenient speed after my decease take into 
their custody & possession all my estate both real & personal aforesaid & 
when any part thereof may be in the possession of others that they sue for 
or otherwise (recover?) & take possession of the same. And Upon Trust that 
as soon as the said Trustees are in possession of my personal estate and 
of any part or the whole of the [illegible] or profits of my real estate, 
that they will apply the whole of the same to the (hole?) & [illegible] 
use & benefit of my loving daughter Sally Childs wife of Thomas Childs of 
Montgomery County. And my will is that he shall not intermeddle - 
therewith neither shall the same be subject or [illegible] to his 
[scratched-out] [illegible] debts or engagements. And the (receipt?) of 
the said Sally Childs [illegible] with her proper [illegible] shall be a 
good and sufficient discharge for as much of the (rents?) & profits of my 
real estate or for so much of my personal estate or the profits thereof as 
shall be therein acknowledged or [illegible] to be received. And Up-on 
Trust Also that the said Walter Leak & William Terry trustees as aforesaid 
will by such good & sufficient (conveyance?) or [illegible] as [illegible] 
shall advise convey or otherwise (assure?) all or any part of my real 
estate either for years, for life, or in fee simple to such person or 
persons as the said Sally Childs (may?) by deed or deeds duly executed or 
by her last will & testament or any writing purporting to be her last will 
& testament (executed?) [illegible] to the [illegible] of this [illegible] 
direct (limit?) and appoint, [illegible] [illegible] her present or any 
future [illegible].

And I nominate & appoint the said Walter Leak, William Terry and my loving 
son James Picket of the County of Richmond & State aforesaid the executors 
of this my last will & testament. And I hereby revoke all other & former 
wills by me made ratifying & confirming this only as my last will & 
testament.
